An injuction is a procedural mechanism aimed at ensuring the effective implementation of the decision following the conduct of a declaratory action.
Normally, in civil proceedings injunctive relief is only sought at the request of the claimant, who must establish the existence of a number of circumstances and only if the claimant provides an undertaking in damages for potential prejudice caused to the defendant; and although this is subject to exceptions, the general rule is that the grant of such injunctive relief is only taken after hearing the defendant.
However, due to the special characteristics of the protection sought from the court, the CPA provides that, on admittance of the lawsuit, the court of its own accord may order the deposit of the goods with which the process is concerned, without the claimant having to provide security and without the defendant being able to oppose the adoption of the measure or request its modification or substitution by another.
